Website Privacy Policy

For website visitors, prospective gym customers, demo users and trial accounts.

This Website Privacy Policy explains how FITSCALE TECHNOLOGIES OPC (“Fitscale,” “we,” “us,” or “our”) collects, uses, discloses, stores, and protects personal information obtained through the Fitscale website, demo-request process, trial-account onboarding, and related pre-subscription communications. It is intended primarily for gym owners, operators, representatives, and other prospective business customers.

This Policy is separate from the Data Processing Agreement (“DPA”) that applies when a Gym becomes a Customer and Fitscale processes Gym Member Personal Data on that Customer’s behalf. Once a prospect becomes a paid Customer, the Fitscale Subscription Agreement, applicable Order Form, and DPA govern the corresponding customer relationship and Member-data processing.

2. Trial accounts and data minimization

Fitscale may permit a prospective Customer to begin a trial without complete business-registration or billing details. Where appropriate, DTI/SEC registration details and TIN may be optional during the trial stage, particularly where the prospective gym is still under registration or construction. Fitscale may require complete and applicable business, billing, and authorized-signatory information before activation of a paid subscription.

Fitscale seeks to collect only information reasonably necessary for the relevant stage of the customer journey. Information requested during a trial does not by itself create a paid subscription.

4. Marketing communications

Consent to marketing is optional and is not a condition for requesting a demo, opening a trial account, or purchasing the Service. Where Fitscale asks for consent to promotional SMS or email, the marketing option should be presented separately from required privacy acknowledgments or service-related communications.

A person who has opted in may withdraw marketing consent using the unsubscribe or opt-out method stated in the communication or by contacting Fitscale. Withdrawal of marketing consent does not affect necessary service, security, billing, or account communications.

Fitscale does not sell personal information. We may disclose or make information available only as reasonably necessary, including to:

The providers used for website/demo communications may differ from the Sub-processors used to process Gym Member Personal Data under the DPA. Where a service provider processes Member Personal Data on behalf of a Customer, its treatment is governed by the DPA and the applicable Sub-processor disclosures.

6. Retention

Fitscale retains lead, trial, and customer-contact information only for as long as reasonably necessary for the purposes described above, legitimate business and legal requirements, dispute resolution, and recordkeeping. Where a prospect does not proceed with a subscription, Fitscale should not retain the prospect’s information indefinitely merely for marketing purposes. Information no longer required will be deleted, anonymized, or otherwise securely disposed of in accordance with applicable law and Fitscale’s retention practices.

Fitscale uses reasonable organizational, technical, and administrative safeguards appropriate to the nature of the information processed. No transmission or storage method is completely secure, and absolute security cannot be guaranteed.

8. Your data-privacy rights

Subject to applicable law, individuals may exercise applicable rights concerning their personal information, including access, correction, objection, restriction, deletion/blocking where applicable, data portability where applicable, and withdrawal of consent where processing is based on consent. 9. Children

The Fitscale website, demo process, and trial onboarding covered by this Policy are intended for gym owners, operators, authorized business representatives, and other prospective business customers, and are not directed to children.

10. Cookies and similar technologies

Fitscale may use cookies, local storage, or similar technologies that are reasonably necessary for website functionality, security, authentication, preferences, and permitted analytics. Where applicable law requires consent for a particular technology or purpose, Fitscale should obtain the required consent before using it.

11. Changes to this policy

Fitscale may update this Policy to reflect changes in law, technology, providers, or business practices. The current version and effective date should be posted on the Fitscale website. Material changes should be communicated where appropriate.
